Terms of Service

RenterMagnet ("RenterMagnet," "we," "us," or "our"), a service of Renter Magnet (a DBA operating from DeLand, Florida), provides an online SaaS platform for property managers, rental experts, and renters. These Terms of Service ("Terms") govern your access to and use of our website, applications, and services (collectively, the "Service").

By accessing or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

1. Website Use

You may use the Service only in compliance with these Terms and all applicable laws. You may not use the Service in any manner that could damage, disable, overburden, or impair our systems or interfere with any other party's use of the Service.

2. Account Creation

To access certain features you must register for an account. You agree to (a) provide accurate, current, and complete information, (b) keep your account information up to date, (c) safeguard your password and restrict access to your account, and (d) accept responsibility for all activities under your account. Accounts are intended for users age 18 or older creating business accounts.

3. User Responsibilities

You are responsible for all content you submit to the Service, all activity that occurs under your account, and your compliance with applicable federal, state, and local laws (including fair housing, advertising, and consumer protection laws).

4. User-Generated Content

You retain ownership of listings, photos, promotions, profiles, messages, and other content you submit ("User Content"). By submitting User Content, you grant RenterMagnet a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, display, distribute, and syndicate the User Content solely to operate and promote the Service, including through partner properties such as Rent-Specials.com.

You represent and warrant that you own or have all necessary rights to your User Content and that it does not violate these Terms, our Acceptable Use Policy, or any third-party rights.

5. Intellectual Property

The Service (including software, design, text, graphics, and the "RenterMagnet" and related marks) is owned by Renter Magnet and protected by U.S. and international intellectual property laws. Except for the limited license to use the Service, no rights are transferred to you. See our Trademark & Brand Usage Policy for brand use guidelines.

6. Prohibited Activities

You agree not to:

  • Post fraudulent, misleading, or inaccurate listings.
  • Impersonate any person or entity.
  • Violate any fair housing, advertising, or consumer protection law.
  • Harass, threaten, or abuse other users.
  • Scrape, reverse engineer, or interfere with the Service.
  • Upload viruses, malware, or other harmful code.
  • Post content you do not have rights to.

7. Account Suspension and Termination

We may suspend or terminate your account at any time, with or without notice, if we believe you have violated these Terms, our policies, or applicable law, or if continued access poses a risk to the Service or other users. You may close your account at any time by contacting us at hello@rentermagnet.com.

8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT LISTINGS, PROFILES, OR OTHER CONTENT WILL BE ACCURATE, COMPLETE, OR CURRENT.

RenterMagnet is a marketing and marketplace platform. We do not lease properties, verify all listing details, or guarantee the outcome of any transaction between renters, property managers, or rental experts.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, RENTERMAGNET AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE AMOUNTS YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE.

10. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to conflicts of law principles. You agree that any dispute arising out of or relating to these Terms or the Service will be brought exclusively in the state or federal courts located in Volusia County, Florida.

11. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the "Effective Date" and post the new version at the same URL. Prior versions remain available on request. Your continued use of the Service after a change constitutes acceptance of the updated Terms.
